TERMS & CONDITIONS
1. THE AGREEMENT
1.1. This agreement sets out the complete terms and conditions (hereinafter called “Terms and
Conditions”) which shall be applicable to PUPHIK Credit limited as a Digital Credit Provider,
in lending platform.
1.2. These Terms and Conditions and amendments or variations thereto take effects on their
date of publication
2. DEFINITIONS
2.1. In these Terms and Conditions, the following words and expressions bear the following
meanings:
2.2. PUPHIK means Puphik Credit limited
2.3. Credit Reference Bureau means a credit reference bureau duly licensed to collect and
facilitate the sharing of borrower’s personal information;
2.4. Call Centre means Puphik credit call center
2.5. Equipment includes your mobile phone handset and or other equipment which when used
together enables you to access our services
2.6. Request means a request and / or instruction received by Puphik crdit limited from you or
purportedly from you through the system and upon which request puphik credit authorized
the act;
2.7. Products means the various loan offered by puphik credit limited;
2.8. Services shall include any form of financial services or products that Puphik Credit limited
may offer you pursuant to this Agreement and as you may from time to time subscribe to
and “service” shall be construed accordingly;
2.9. Security agreement constitutes the legal, Valid, binding and enforceable obligations of the
borrower and will continue to be effective overall and every part of the secured asset;
2.10. Secured asset is the asset over which the loan facility is secured;
2.11. SMS means a service for sending short messages of up to 160 character 224
character limit using a 5-bit mode to mobile devices including cellular phones and
smartphones;
2.12. MPESA means the Safaricom Kenya Limited mobile money transfer and payments
services by puphik credit limited through Safaricom network
2.13. System means Puphik Credit ltd electronic lending platform and communications
software enabling the borrower to communicate with Puphik credit limited for the purpose
of services;
2.14. Transaction cost means charges levied by other 3rd parties service providers which
includes but is not limited to Mpesa and bank transaction charges.
2.15. We, our, and us means puphik credit limited and includes successors and assigns of
Puphik credit limited
2.16. You and your means the borrower and includes the personal representatives of the
borrower;
2.17. The word borrower, customer or clients shall be include both the masculine and the
feminine gender as well as the juristic persons;
2.18. Words importing the singular meaning where the context so admits include the
meaning and vice versa
2.19. Customer or client(s) means a person in whose name the Puphik Credit Limited is
existing
2.20. KYC means Know Your Customer
2.21. Company means puphik credit limited;
2.22. T&C’s means these Terms and Conditions
3. ACCEPTANCE OF THE TERMS AND CONDITIONS
3.1. Before applying for Puphik credit limited products on our system, you should first carefully
read and understand these Terms and Conditions which will govern the use and operations
of our system and the products and services accessible thereof:
3.2. Thereafter you will be required to be registered on our system.
3.3. By proceeding with the registration, you are agreeing that you have accepted our Terms and
conditions.
3.3.1. Furthermore, you will be deemed to have read, understood and accepted these
Terms and Conditions by following through all the prompts and completing a request
transaction.
3.4. By accessing our system and completing a request, you agree to comply with and be bound
by these Terms and Conditions and you affirm that Terms and Conditions herein are without
prejudice to any right that Puphik Credit limited may have with respect to the services or
products offered in law or otherwise
3.5. These Terms and Conditions may be amended or varied by Puphik Credit Limited from time
to time and completion of request and continued use of this service constitutes your
agreement to be bound by the terms of any such amendment or variation
4. REGISTRATION
4.1. In order to register with us you must be at least Eighteen (18) years old.
4.2. Our system requires that you register by creating and account to Enable access our various
products;
4.3. You agree to be responsible for maintaining the confidentiality of passwords or other
account identifiers which you choose and all other activities that occur on your equipment;
4.4. By signing up or otherwise using our system, you have read and understood our Terms and
Conditions of registration on our official website or through our office and you agree to be
bound by these Terms and Conditions;
4.5. You hereby agree and authorize Puphik Credit Limited to obtain and procure your personal
information contained in the IPRS from the Government of Kenya and you agree and
consent to the disclosure and provision of such personal information by the Government of
Kenya to Puphik Credit Limited
4.6. You hereby authorize Puphik Credit Limited to access any information available to assess
your request , and also gives Puphik Credit Limited permission to subject your information to
our credit scoring engine to Puphik Credit limited;
4.7. Puphik Credit limited reserves the right to request for further information from you
pertaining to your application for Puphik Credit limited services or products. Failure to
provide such information within the time required by puphik credit limited results in
declining your request for loan facility;
4.8. If you do not accept these Terms and Conditions of Registration, then you should not
proceed with the registration or filling Puphik credit limited application forms
4.9. Upon successful registration, you are advised to read and familiarize yourself with the
Terms and Conditions of each of the products as you shall be bound by the said terms and
conditions of each products;
5. VARIATION AND TERMINATION OF RELATIONSHIP
5.1. If you have not used our products 3 years from the last date you did transaction with us.
5.2. Where such a suspension or variation is necessary as a consequence of technical problems
or for reasons of safety
5.3. If the puphik credit limited detect, any abuse/misuse, breach of context, fraud relating to
your use of service.
5.4. If agreement with mobile network is terminated for whatever the reasons.
5.5. If the Puphik credit limited decides to suspend or cease the provision of the service for any
reasons or for any other reason as it may determine in its absolute discretion.
5.6. If you give an instruction for deletion of your personal data so long there is no pending
transaction between you and our company
6. CUSTOMER COMPLAINTS
6.1. Complaints may be made in person, in writing, emails or by mobile
6.2. The company on receiving your complaint shall provide you with a prompt written
acknowledgement within 48 hours and resolve the complaint in 14 working days. If the
complaint is not resolved within the 14days, a written update will be forwarded to you on
the progress of resolving the complaints.
6.3. Applicable tariffs will be charged by your telephone and internet service provider(s) when
communicating with our office customer Care
7. DISPUTE RESOLUTION, JURISDITION AND ARBITRATION
7.1. You may contact the contact any of Puphik Credit Limited office +254 714 262 211 to report
any disputes, claim or Puphik Credit limited discrepancies.
7.2. Any disputes arising out or in connection with this agreement that is not resolved on time by
a branch be should reported in writing through our emails info@puphikcredit.com
7.3. Any dispute arising between the parties and which is not amicably resolved shall be subjects
to the Courts of Kenya at the election of either party or
7.4. The parties hereby agree that the arbitration shall have power, inte alia, to
7.4.1. Act in the default of the parties
7.4.2. Award security for costs and order the preservation of evidence
7.4.3. Make provisional awards
7.4.4. Consolidate proceedings and concurrent headings
7.4.5. Apply the law determined by the conflict, of laws rules which it considers applicable
7.5. To the extent permissible by law, the determination of the arbitrator shall be final,
conclusive and binding on upon the parties.
8. BORROWER’S EQUIPMENTS AND BORRWER’S RESPONSIBILITIES
8.1. You shall at your own expenses provide and maintain in safe and efficient operating order
your equipment for the purposes of accessing our services.
8.2. You agree and acknowledge that you shall be solely responsible for the safekeeping and
proper use of you equipment. Puphik credit limited shall not be liable of any loss
accessioned by third party who comes into contact with you equipment.
9. EXCLUSION LIABILITY.
9.1. Puphik credit limited will not be liable to any losses, damages suffered by you as a result of
or in connection with:
9.1.1. Failure, multifunction and interpretation of your equipment.
9.1.2. Any fraudulent or illegal use of your equipment
9.1.3. Your failure to comply with the Terms and Conditions
9.1.4. Damages, Failure or transfer of your personal data to third parties by way of clicking
on links through your equipment or otherwise.
10. YOUR REQUEST
10.1. You acknowledge that Puphik credit limited will not be liable for any transaction, any
activity or any incident on your equipment whether or not accessioned by negligence.
10.2. Puphik credit limited may decline your request in accordance of whole or partly of your
request either partly or whole in written or otherwise pending further inquiry or
confirmation from you.
10.3. Puphik Credit reserves the right and is entitled to act upon any request, even if that
request is otherwise for any reason incomplete or ambiguous if, in its absolute
discretion,
10.4. Puphik Credit limited believes that it can correct the incomplete or ambiguous
information in request without any reference to you being necessary.
11. LOAN TERMS AND CONDITIONS
11.1. The Loan Letter of Offer
11.1.1. At your request, Puphik Credit Limited agrees to make available to your advised loan
amount on the terms and conditions set out in this agreement.
11.1.2. You have right to pay the principal amount within 2 business working days from the day
of disbursement upon payment of the administrative cost. All repayment must be done
to Puphik Credit Limited’s account EQUITY bank account 0240278570446 (Harambee
Avenue Branch) or ABSA bank account 2044652180 (Bomet branch) or on our Mpesa
Pay Bill number 517601: use (Borrower’s ID No or reference numbers provided)
12. BREACH
12.1. In the event;
12.2. Any failure by you to pay any amount which is owing to this agreement in full and on
the dates you to, or
12.3. Any other breach by you of the terms of this agreement;
12.4. In the event of a default by you in making payments to puphik credit limited shall
have right to use any money paid by you to first pay legal fee and other cost, then
interest and then the actual principal.
12.5. Puphik credit limited reserve the right to engage third party debt collectors to
recover any total outstanding balance at your cost.
13. GENERAL
13.1. Emergency- Private Loan, Puphik credit disbursement is done via MPESA upto a
maximum of KES 150,000.00 or Disbursement via the mode of your request that’s Real
Time cross settlement, internal transfer or Pesa link through our main bank account.
13.2. For Emergency-Check off loan in case of default we shall be following up with the
employer if the deduction only if the deductions is effected in your payslip.
13.3. Loan amount for other products the Emergency-Personal loan and Emergency-
Business loan ranges from KES.5, 000.00 and KES 200,000.00 depending your ability and
capability to repay.
14. PUPHIK CREDIT LIMITED PROTECTION POLICY
14.1. It is hereby understood and agreed that the data has been provided or obtained
from the borrower who has provided this data to Puphik credit limited for the purposes
of loan facility
